What our conditions are
1. ACCEPTANCE OF TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Siouxland Splash Waterpark (“Siouxland Splash,” “Company,” “we,” “our,” or “us”) and all persons who enter, access, or use the premises or services (collectively, “Guests”).
By purchasing admission, entering the premises, or using any facilities, Guests acknowledge and agree to be bound by these Terms.
2. ADMISSION AND TICKETING
All admission to Siouxland Splash is subject to presentation of a valid ticket or authorized entry. Siouxland Splash reserves the right to:
- Refuse admission to any person at its sole discretion
- Limit park capacity
- Modify operating hours, attractions, or availability without prior notice
All ticket sales are final unless otherwise required by applicable law. Lost, stolen, altered, or unused tickets will not be replaced or refunded.
3. HOURS OF OPERATION AND CLOSURES
Operating hours are subject to change without notice due to weather conditions, maintenance requirements, safety concerns, or other operational factors.
Certain attractions may be unavailable at any time. No refunds or credits shall be issued due to temporary closures or limited availability, except as expressly provided in Section 10 (Weather Policy).
4. CODE OF CONDUCT
Guests shall behave in a safe and respectful manner at all times. Prohibited conduct includes, but is not limited to:
- Running, horseplay, or unsafe physical behavior
- Disorderly, abusive, or unlawful conduct
- Intoxication or impairment
- Damage to property
- Failure to follow posted rules or staff instructions
Violation of this Section may result in removal from the premises without refund.
5. HEALTH AND SAFETY REQUIREMENTS
Guests must comply with all posted and verbal safety instructions, including:
- Height, weight, and health restrictions for attractions
- Directions from lifeguards and park personnel
- Proper use of rides, slides, and equipment
Guests with medical conditions or physical limitations that may increase risk are responsible for refraining from participation where appropriate.
6. ASSUMPTION OF RISK
Guests acknowledge that waterpark activities involve inherent risks, including but not limited to slips, falls, drowning, collisions, and equipment-related hazards.
By entering Siouxland Splash, Guests voluntarily assume all risks associated with use of the premises and participation in activities.
7. RELEASE OF LIABILITY
To the fullest extent permitted by Iowa law, Guests agree to release, waive, and discharge Siouxland Splash, its owners, officers, employees, and agents from any and all claims arising from ordinary negligence.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct.
8. MINORS
Guests under eighteen (18) years of age must be accompanied and supervised by a parent or legal guardian.
The supervising adult assumes full responsibility for the safety, conduct, and supervision of all minors in their care.
9. PERSONAL PROPERTY
Guests are solely responsible for their personal belongings. Siouxland Splash shall not be liable for loss, theft, or damage to personal property except as required by law.
Lockers may be available for use subject to availability and applicable fees.
10. WEATHER POLICY
For the safety of Guests and staff, Siouxland Splash may suspend or close operations due to weather conditions, including but not limited to lightning, severe storms, or other hazardous conditions.
If Siouxland Splash closes for the remainder of the operating day due to weather, Guests who have been admitted on that day may exit the premises and return on a future operating day for one (1) complimentary re-entry, subject to the following conditions:
- Guests must retain and present valid proof of purchase dated for the day of closure
- Complimentary re-entry is valid for a single future visit only
- Re-entry has no cash value and is non-transferable
- Siouxland Splash reserves the right to require identification to match proof of purchase
- This policy applies only when the park ceases operations for the remainder of the day and does not apply to temporary delays or partial closures
All Guests must follow staff instructions and exit the premises in a safe and orderly manner when directed.
11. FOOD, BEVERAGES, AND PROHIBITED ITEMS
Siouxland Splash reserves the right to regulate outside food, beverages, and personal items.
The following items are prohibited:
- Glass containers
- Weapons or hazardous materials
- Illegal substances
- Any item deemed unsafe or disruptive by management
All bags and personal items may be subject to inspection.
12. SURVEILLANCE AND SECURITY
The premises are monitored by video surveillance for safety and security purposes. By entering Siouxland Splash, Guests consent to such monitoring.
13. PHOTOGRAPHY AND MEDIA RELEASE
By entering Siouxland Splash, Guests grant permission for their likeness to be photographed or recorded and used for promotional, advertising, or operational purposes without compensation, to the extent permitted by law.
14. REFUSAL OF SERVICE
Siouxland Splash reserves the right to refuse admission or remove any Guest for violations of these Terms or for behavior deemed unsafe, unlawful, or disruptive.
No refund shall be issued in such cases.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Siouxland Splash shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of its facilities or services.
16. INDEMNIFICATION
Guests agree to indemnify and hold harmless Siouxland Splash from any claims, damages, or liabilities arising out of their conduct or violation of these Terms.
17. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa. Any disputes shall be resolved exclusively in courts located within the State of Iowa.
18. MODIFICATIONS
Siouxland Splash reserves the right to modify these Terms at any time. Updated Terms shall become effective immediately upon posting.
19. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
