What this privacy policy covers

1. INTRODUCTION

This Privacy Policy and Terms of Use (the “Agreement”) governs the collection, use, and disclosure of personal information by Siouxland Splash Waterpark (“Siouxland Splash,” “Company,” “we,” “our,” or “us”), as well as the terms and conditions applicable to all guests, visitors, and users (collectively, “Guests”).

By entering the premises, purchasing admission, or accessing any services provided by Siouxland Splash, Guests acknowledge and agree to be bound by this Agreement.

2. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Iowa.

3. COLLECTION OF INFORMATION

Siouxland Splash may collect the following categories of information:

A. Personal Information
Including, but not limited to: name, address, email address, telephone number, and payment information.

B. Transactional Information
Records of purchases, reservations, admissions, and participation in attractions.

C. Safety and Security Information
Video recordings obtained through surveillance systems located throughout the premises for security and operational purposes.

D. Information Concerning Minors
Information relating to individuals under the age of eighteen (18) may be collected solely with the consent of a parent or legal guardian, where required by applicable law.

4. USE OF INFORMATION

Collected information may be used for the following purposes:

  • To provide admission, services, and guest support

  • To ensure the safety and security of all Guests and staff

  • To comply with applicable legal and regulatory requirements

  • To process transactions and prevent fraudulent activity

  • To improve operations, facilities, and guest experience

  • To communicate with Guests regarding updates, policies, or promotional materials

5. DISCLOSURE OF INFORMATION

Siouxland Splash does not sell personal information. Information may be disclosed under the following circumstances:

  • To third-party service providers performing functions on behalf of the Company

  • To emergency personnel when necessary to protect health or safety

  • To governmental authorities or law enforcement when required by law

  • In connection with a merger, acquisition, or sale of assets

6. DATA SECURITY AND RETENTION

Siouxland Splash implements reasonable administrative, technical, and physical safeguards to protect personal information. Notwithstanding the foregoing, no method of transmission or storage is completely secure.

7. GUEST RIGHTS

Subject to applicable law, Guests may request access to, correction of, or deletion of their personal information by contacting the Company using the information provided below.

Guests may opt out of receiving promotional communications at any time.

TERMS OF USE

8. ASSUMPTION OF RISK

Guests acknowledge that participation in waterpark activities involves inherent and unavoidable risks, including, but not limited to, bodily injury, illness, permanent disability, or death. Such risks may arise from, without limitation:

  • Slippery surfaces

  • Water-related hazards, including drowning

  • Equipment malfunction or misuse

  • Actions or omissions of other Guests

By entering the premises, Guests knowingly and voluntarily assume all such risks.

9. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by Iowa law, each Guest, on behalf of themselves and any minor under their supervision, hereby releases, waives, and discharges Siouxland Splash, its owners, officers, employees, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to ordinary negligence.

This release shall not apply to claims arising from gross negligence, willful misconduct, or any liability that cannot be waived under applicable law.

10. RULES AND COMPLIANCE

All Guests shall comply with posted signage, written policies, and instructions provided by staff, including but not limited to:

  • Height, weight, and health restrictions

  • Lifeguard directions

  • Prohibitions on running, horseplay, or unsafe conduct

Failure to comply may result in immediate removal from the premises without refund.

11. MINORS AND SUPERVISION

Guests under the age of eighteen (18) must be accompanied and supervised by a parent or legal guardian. The supervising adult assumes full responsibility for the conduct, safety, and well-being of such minor.

12. HEALTH AND SAFETY COMPLIANCE

Siouxland Splash operates in accordance with applicable Iowa public health regulations governing aquatic facilities, as well as all relevant local ordinances and safety requirements.

13. CODE OF CONDUCT

Guests shall not:

  • Engage in unsafe, unlawful, or disruptive behavior

  • Damage or misuse property

  • Introduce prohibited or hazardous items onto the premises

  • Interfere with the safety or enjoyment of other Guests

14. SURVEILLANCE

Guests acknowledge and consent to the use of video surveillance throughout the premises for purposes of safety, security, and operational oversight.

15. REFUSAL OF SERVICE AND REMOVAL

Siouxland Splash reserves the right, in its sole discretion, to refuse admission or remove any Guest whose conduct is deemed unsafe, unlawful, or in violation of this Agreement. No refund shall be issued in such cases.

16. FORCE MAJEURE

Siouxland Splash shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, weather conditions, governmental actions, or emergencies.

17. MODIFICATIONS

Siouxland Splash reserves the right to amend this Agreement at any time. Updated versions shall be posted and become effective immediately upon publication.

18. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
